1. Services
DVFX provides professional video editing, color grading, motion graphics, sound design, and related post-production services (collectively, "Services"). The scope, deliverables, and timeline for each project will be agreed upon in writing before work begins.
2. Pricing & Payment
All pricing is as quoted on our website or as agreed upon in a custom proposal. A 50% deposit is required before work begins, with the remaining balance due upon delivery of the final files. Late payments may incur a 5% monthly fee.
3. Revisions
Each package includes a specified number of revision rounds as outlined in your plan or proposal. Additional revisions beyond the included rounds will be billed at our standard hourly rate.
4. Intellectual Property
Upon full payment, all rights to the final deliverables transfer to the client. DVFX retains the right to showcase completed work in our portfolio and marketing materials unless a Non-Disclosure Agreement (NDA) is in place.
Raw project files (e.g., Premiere Pro, After Effects files) are not included in standard deliverables unless explicitly stated in the agreement or included in your selected plan.
5. Client Responsibilities
- Provide all necessary raw footage, assets, and creative direction in a timely manner
- Ensure you hold the rights to all materials provided to us
- Respond to revision requests and approvals within the agreed timeframe
- Delays caused by late client responses may impact the project timeline
6. Limitation of Liability
DVFX shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability for any claim shall not exceed the amount paid by the client for the specific project in question.
7. Cancellation & Refunds
Projects may be cancelled with written notice. If cancellation occurs after work has begun, the deposit is non-refundable. Refunds for completed milestones will be assessed on a case-by-case basis.
8. Confidentiality
We treat all client materials and project details as confidential. We will not share, sell, or distribute your content or information to third parties. NDAs are available upon request for sensitive projects.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States. Any disputes arising under these Terms shall be resolved through binding arbitration.
